By accessing and using WA Bot Platform (“we”, “us”, “our”, “Service”), you agree to these Terms of Service. Please read them carefully before using the Service.

1. Service Description

WA Bot Platform provides an automated chat service for WhatsApp. Our Service enables businesses to create AI-powered chatbots that respond to customer messages on WhatsApp automatically.

IMPORTANT — Unofficial WhatsApp Automation Disclosure: Our Service uses unofficial WhatsApp automation technology (whatsapp-web.js + browser automation) that interacts with WhatsApp Web on your behalf. We do NOT use the official WhatsApp Business API.

This technology may violate WhatsApp's Terms of Service at Meta's sole discretion. By using our Service, you acknowledge and accept this risk.

2. WhatsApp Number Restrictions — No Liability

You acknowledge and understand the following:

  • WhatsApp/Meta may at any time restrict, suspend, or permanently ban phone numbers that use unofficial automation tools.
  • We cannot and do not guarantee that your WhatsApp number will remain active while using our Service.
  • We are NOT responsible and assume NO liability if your WhatsApp number is banned, restricted, or suspended by Meta/WhatsApp as a result of using our Service.
  • We cannot restore banned WhatsApp numbers under any circumstances.
  • We are unable to negotiate or communicate with WhatsApp/Meta on your behalf regarding banned accounts.

To minimize the risk of restrictions, we implement rate limiting, human-like response delays, and other precautions. However, the decision to restrict any number rests entirely with Meta/WhatsApp, and we bear no responsibility for their actions.

3. Your Account

To use our Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete information when registering
  • Keep your password confidential and secure
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized access

4. Credits and Billing

  • We operate on a prepaid credit model
  • Credits are consumed per AI API call (bot reply or classification)
  • Current pricing is displayed in your dashboard and is subject to change
  • Credit balances do not expire but are non-transferable between accounts
  • We reserve the right to modify pricing with 30 days advance notice via email

Summary:

  • Unused credit balance is refundable within 30 days of purchase
  • If your WhatsApp number is banned, restricted, or suspended, we will refund your unused credit balance upon request
  • Credits already consumed (used API calls) are non-refundable
  • Refunds are processed within 7-10 business days to the original payment method

6. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, bulk unsolicited messages, or promotional content to people who haven't opted in
  • Impersonate others or misrepresent your identity
  • Violate any applicable laws or regulations
  • Promote illegal activities, including but not limited to fraud, scams, or illicit products
  • Harass, abuse, threaten, or harm others
  • Transmit malware, viruses, or malicious code
  • Scrape, reverse-engineer, or attempt to extract our source code or infrastructure
  • Resell or redistribute the Service without written permission

Violations may result in immediate account suspension without refund of used credits.

7. Content and Data

You retain full ownership of the content you provide to the Service (bot personality, knowledge base, messages). By using the Service, you grant us a limited license to process this content solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that your bot's content, knowledge base, and responses comply with applicable laws and do not infringe on third-party rights.

8. AI-Generated Responses

The Service uses third-party AI models to generate bot responses.

  • AI-generated responses may contain errors, inaccuracies, or hallucinated information
  • You are responsible for reviewing bot behavior and the accuracy of automated responses
  • We are not liable for damages caused by incorrect or inappropriate AI responses
  • You should not use the Service for medical, legal, or financial advice

9. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in activities that harm our Service or other users. Upon termination, you may request a refund of your unused credit balance within 30 days.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, reliability, or availability of AI-generated responses.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • WhatsApp account bans, suspensions, or restrictions by Meta
  • Lost revenue, profits, or business opportunities
  • Data loss or corruption
  • Damages resulting from AI-generated content
  • Service downtime or interruptions

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in India, and subject to the exclusive jurisdiction of the courts of your registered city in India.
